1. Introduction
These Terms and Conditions ("Terms") govern the contract ("Contract") for the subscription and use of Digital Defender. By subscribing to Digital Defender, you agree to these Terms. If you do not agree, you will not be able to purchase or use the service.
By clicking "Register" on our website, you confirm that you have read and accepted these Terms. You will receive a copy of these Terms in the Welcome Email. We may revise these Terms from time to time as per Section 5.
The Terms, Contract, and communications are in English and governed by the laws of England & Wales. Please note specific sections related to our liability (Section 2), the features of Digital Defender (Sections 3 and 4), and how to cancel your subscription (Section 6).

3. Key Definitions

Compromised Data Alert: A notification if your monitored data has been compromised.

Database: A collection of compromised personal data obtained from unsecured or illegal sites.

Monitored Data: Personal data you register with us (e.g., email, phone numbers, or credit card details) that is monitored by Digital Defender.

Subscription: Your ongoing, paid subscription to Digital Defender services.

Monthly Fee: The cost for the Digital Defender service, outlined in your Welcome Email.

Start Date: The date your subscription begins, as shown in your Welcome Email.
4. Subscription Terms
4.1 Eligibility
By subscribing, you confirm that you:

Are 18 years of age or older and reside in the United Kingdom.

Provide accurate, up-to-date information for your subscription.

Notify us of any changes to your contact information via the Membership Area or by contacting us directly.
4.2 Contract Formation
The contract is formed when we accept your order by sending a Welcome Email. Your subscription starts on the Start Date specified in that email.
If there is an issue with your order (e.g., a pricing error), we will inform you, and no payment will be processed until the issue is resolved. If payment is made in error, it will be refunded within 5 working days.
4.3 Subscription Duration and Fees

Your subscription begins on the Start Date and renews monthly unless canceled.

You will be charged £29.95 monthly after an initial verification fee of £0.16. Both fees will be charged according to the timeline outlined in your Welcome Email.

Payment will be taken from the card you provide. We do not specify an exact billing date but charge at regular monthly intervals. Should your payment fail, we will retry until successful.

Any changes to fees will be communicated at least 30 days before the change. If you do not agree, you may cancel your subscription as outlined in Section 6.
5. Updates to Terms
We may update these Terms to reflect changes in our services, technology, law, or market conditions. Any updates will be communicated in advance, and if you do not agree to the changes, you can cancel your subscription. No updates will reduce the service described at the time of your subscription without your consent.
6. Cancellation and Refunds
6.1 Your Right to Cancel
You have the right to cancel your subscription within 30 days of your Start Date for a full refund, without giving a reason. This is your legal right under the Consumer Contracts Regulations.
To cancel:

Via the quick cancellation tool, the URL will be provided in your welcome e-mail.

We will acknowledge your cancellation request and process the refund within 14 days.
6.2 Cancellation After the 30-Day Period
You may cancel your subscription at any time. If canceled mid-month, you will not receive a refund for that month, but your subscription will not renew for the next cycle. Refunds for accidental overpayments will be processed within 5 days.
6.3 Our Right to Cancel
We may cancel your subscription with immediate effect if:

You fail to pay the monthly fee.

You provide false information.

You misuse the service (e.g., fraudulent use).
If we cancel your subscription for any of these reasons, no refund will be provided for unused service. We may also cancel for legal reasons or by giving you 30 days' notice, in which case we will refund any unused portion of your monthly fee.
7. Service Features
Upon subscription, you can log in to the Membership Area to access the Digital Defender services, where you can monitor your personal data and receive alerts.
7.1 Limitations

We monitor only the data you provide. We cannot monitor other types of personal information.

We cannot guarantee that all unsecured or illegal sites will be discovered.

Alerts are based on the data available in our database at the time of monitoring.
7.2 Alerts and Notifications
You will be notified if your monitored data is found on compromised websites via email or SMS. Monthly summaries will also be available through the Membership Area.
8. Liability and Disclaimer
8.1 Personal Use
Digital Defender is provided for personal, non-commercial use only. We are not liable for any losses related to business or commercial use.
8.2 Foreseeable Losses
We are only responsible for losses caused by our breach of contract or negligence that are foreseeable. Losses are foreseeable if they are an obvious consequence of our breach.
8.3 Limitations
We are not liable for any failure or delay in service caused by events outside of our control, such as natural disasters, strikes, or interruptions to telecommunications networks.
9. Data Privacy
We respect your privacy and handle personal data according to the General Data Protection Regulation (GDPR). All personal data in your Membership Area is anonymized and encrypted. For more details, refer to our Privacy Policy.
10. Complaints and Dispute Resolution
If you have a complaint, please contact us at support@digitaldefender.co.uk, or call us at 0330 350 2732. We aim to resolve complaints within 5 working days and provide updates if more time is required. Disputes will be governed by the laws of England & Wales, and the courts of England will have exclusive jurisdiction.
